Petitioner is aggrieved by the fact that in respect of similar allegations, different police stations have registered FIR. The prayer in the writ petition is with reference to New Market P.S. Case No. 108 dated 15.08.2024, Amherst Street P.S. Case No. 114 dated 07.09.2024 and Taltala P.S. Case No. 92 dated 10.09.2024. It has been informed that the petitioner was granted anticipatory bail in connection with Amherst Street P.S. Case No. 114 dated 07.09.2024.

Learned advocate appearing for the petitioner submits that subsequently in connection with New Market P.S. Case No. 108 dated 15.08.2024, petitioner was served with a notice under Section 35(3) of BNSS.

In view of the submissions of the learned advocate for the petitioner as well as the State not

being able to apprise this Court regarding the progress or steps taken by the police authorities of Taltala P.S. Case No. 92 dated 10.09.2024, I direct the police authorities would before taking any harsh steps issue notice under Section 35(3) of BNSS to the petitioner, if not already served. With the aforesaid observations, the writ petition being WPA 25225 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
