This is an application assailing an order dated 12th September, 2022 passed by the learned Senior Municipal Magistrate, Kolkata in connection with GR Case No. 126/2021 being a proceeding under Section 401A of the Calcutta Municipal Act. By passing the impugned order, the learned Magistrate issued warrant of arrest against the accused. Mr. Dinda, learned Advocate on behalf of the Kolkata Municipal Corporation has entered appearance. The learned Advocate for the petitioner has served a copy of the application to Mr. Dinda.

Having heard the learned Advocates for the parties, the instant revision is disposed of directing the petitioner to surrender before the Trial Court by 6th December, 2022. In the meantime, the impugned order dated 12th September, 2022 shall be kept in abeyance.

The application is, thus, disposed of.
