The appellant is in custody since 29th of July, 2025, the petitioner is the Superintendent of Hostel and teacher of school where the deceased was studying. The investigation has already been concluded and charge-sheet has been submitted before the jurisdictional Court.

Learned advocate for the State has produced the Case Diary.

I have perused the statement, particularly of the mother of the deceased girl as well as that of the roommate, on an assessment of the same and the nature of the accusations including the complicity which has been attributed to the present appellant, I am of the view that further detention of the

appellant is unwarranted. Accordingly, the prayer for bail of the appellant is allowed.

As such the appellant namely, Amalesh Das @ Tufan Das shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, POCSO Court, Tamluk, Purba Midnapore.

If on bail, the appellant shall be physically present on each and every date before the learned trial Court in seisin of the case. The appellant shall not leave the jurisdiction of district of Purba Midnapore without the prior permission of the learned Special Court.

Accordingly, CRA (SB) No. 164 of 2025 is allowed. Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
