For the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of proceeding being C.R. case no. 330 of 2016 pending before the learned Additional Chief Judicial Magistrate, Durgapur, Paschim Bardhaman the matter may be considered without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the case. It appears from the record that the case is pending before the learned trial Court since 2016. Learned counsel for the petitioner submits that six dates have been fixed for recording plea despite which plea is yet to be recorded.

Keeping in mind the age of the proceeding, learned trial Court is directed to record the plea on the next date of hearing fixed before him and if the same is not possible due to adequate reasons, then one month thereafter. Learned trial Court shall conclude the trial within six months from the date the plea is recorded, without granting any unnecessary adjournment to either of the parties, in accordance with law.

The revisional application is disposed of.
