Rejected that from the possession of the petitioner 379 grams of heroin were allegedly recovered and he was arrested on or about 16th May, 2025 and since then he is in custody, although charge-sheet has been submitted, no efforts have been taken by the investigating agency till date to commence the trial of the case.

Learned advocate for the State is present and it has been shown from the records of the case that learned trial court has fixed 9th December, 2025 for consideration of charges. Having regard to the stage of the case, the prayer for bail of the petitioner in CRM (NDPS) 1373 of 2025 is dismissed. However, since 12 witnesses have been relied upon by the prosecution, learned trial court would take steps so that by 31st December, 2026 the evidence of the prosecution is completed.
