Rakib (Rejected) CRM (M) 2187 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Mathurapur Police Station Case No. 34 of 2022 dated 09.02.2022 under Sections 302/201/34 of the Indian Penal Code. And In the matter of : Ajahar @ Ajaharuddin Laskar @ Raja ......Petitioner.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for three years and eight months. It has been admitted by the petitioner himself that earlier the prayer for bail has been rejected, but there were directions for that the trial could be completed expeditiously. So far as the stage of the case is concerned when the order was passed, PW17 was being examined. Accordingly, learned advocate for the petitioner submits that till date only the examination of PW17 has been completed out of the 38 witnesses proposed to be examined by the prosecution. Mr. Bhattacharya, learned advocate appearing for the State submits that State intends to examine four more witnesses. Majority of the period after the order was passed by the Hon'ble High Court, the trial Court was lying vacant, as

such the examination of the prosecution witnesses could not be completed.

In view of the fact that only four witnesses have been proposed to be examined by the prosecution, I direct that the examination of all the four witnesses be concluded by 31st of December, 2025. Petitioner would cooperate with the learned trial Court.

It is further directed that the evidence of this case will continue, irrespective of any resolution taken by the local Bar. Petitioner would be at liberty to approach this Court with similar prayer, in case there is non-compliance of the aforesaid order.

However, at this stage CRM (M) 2187 of 2025 is dismissed.

Report so submitted by the State be kept with the record.

Learned advocate for the State is granted liberty to communicate this order to the learned trial Court through the investigating officer or any other competent officer. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
