State has submitted a report as well as the case diary. Investigation of the case is under progress, till date number of witnesses have been examined and the accused persons who were named by the petitioner have been implicated.

I find that names of eight accused persons along with 6 to 7 unknown persons being implicated as accused. The SDPO, Contai, Purba Medinipur is conducting the investigation of the case. Let the investigation be taken to its logical conclusion within a reasonable period of time.

Mr. Bagchi, learned advocate appearing for the petitioner is apprehensive particularly with regard to the security of the petitioner and his family members as well as the close proximity of the local police station with the accused persons whom he has

named which may jeopardize the future prospects of the present case.

So far as the issue relating to security of the petitioner and his family members are concerned, if any application is made before the learned special court, the learned special court would call for a threat perception report and on receipt of the threat perception report learned special court would pass directions under the Witness Protection Scheme, 2018. The learned special court would take into account if the accused persons are exerting any influence to that extent, if required, the SDPO, Contai will submit a report before the learned special court. If any earlier informations were sent by post to the police authorities concerned, the same may be treated as part and parcel of the case diary which the investigating officer would also take into account and the present FIR/letter of complaint may be treated as continuation of the earlier part.

Accordingly, WPA 25246 of 2024 is disposed of.

There will be no order as to costs.

Case diary be returned to the learned advocate appearing on behalf of the State.

Report so submitted be kept with the record.

A copy of the progress report without annexures be handed over to the learned advocate appearing on behalf of the petitioner.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
