CESC Limited and others Mr. Indranil Halder .... for the petitioner Mr. Suman Ghosh .... for the CESC Limited Learned counsel for the petitioner contends that despite the petitioner having deposited a substantial amount of money as service charges and additional security deposit for the purpose of increasing the electricity load, such load has not yet been increased by the CESC Limited.

Learned counsel for the CESC Limited submits that due to several background reasons, such additional load cannot be given to the petitioner. It is further submitted that the amount-in-question was received due to technical error on the part of the CESC Limited.

On instruction, learned counsel for the petitioner submits that the petitioner has no objection if the CESC Limited returns the amount paid to the CESC Limited, being Rs.86,170/-.

Since none of the parties have any objection thereto, WPA No. 24746 of 2022 is disposed of by directing the CESC Limited to refund the amount of Rs.86,170/-, as appearing in the bill annexed at page-17 (Annexure P/5) of the writ petition, as expeditiously as possible, positively within a fortnight from date.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
