Kausik (Rejected) CRM (NDPS) 1376 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Baishnabnagar Police Station Case No. 918 of 2024 dated 02.09.2024 under Sections 21(c)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 121 days and the person from whose house the recovery was effected has already been granted bail by a Co-ordinate Bench. It has also been submitted that petitioner has only been named by co-accused persons and there has been no recovery from the present petitioner.

Learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner was declared as a proclaimed offender and thereafter he was arrested by the Investigating Agency.

Having regard to the period of retention of the present petitioner, stage of the case and the gravity of the offence, at this stage, I am not inclined to release the petitioner on bail.

Petitioner is granted liberty to approach this Court after the stage of consideration of charge is over. Accordingly, CRM (NDPS) 1376 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
