Petitioner has challenged the continuance of the proceedings relating to Malda P. S. Case No. 324 of 2023 dated 24-06-2023 under Sections 448/354B/325/409/506/354D/34 IPC and S.10 of the POCSO Act. .

I find from the enclosures of the revisional application that some of the statements under S.161 of the Cr.PC but the chargesheet has not been enclosed. It is not possible to ascertain as to whether the victim gave statement under Section 164 of the Code of Criminal Procedure and what the other materials appearing and/or have surfaced in course of investigation. In view of the aforesaid, I grant liberty to the petitioner to take up all the points canvassed in the present revisional application at the stage of consideration of charges. No interference is made by this court at this stage. With the above observations, the present revisional application being CRR 4017 of 2023 is disposed of.
