The ambit of the present writ petition is limited.

The petitioner submits that despite a specific direction dated September 24, 1998 passed in W.P. 17923(W) of 1998 to the effect that the District Collector was to consider and dispose of the representation of the writ petitioner by passing a reasoned order, no such steps have been taken.

When the writ petitioner approached the West Bengal Land Reforms and Tenancy Tribunal with the said grievance, a report was sought by the Tribunal.

It was suggested by learned counsel for the writ petitioner on an earlier occasion when we took up the matter, that instead of the Tribunal, if the respondent authorities submit such report before this court, the matter can be expedited. 5.

In deference to a direction given by us pursuant to such request of the writ petitioner, the respondent authorities file a report today, from which it appears that the respondent authorities seek certain documents to be furnished by the writ petitioner in order to enable the respondent authorities to decide the representation of the writ petitioner.

Such report is kept on record.

Accordingly, we dispose of COLRT 4 of 2025 by directing the respondent no.3, that is, the District Compensation Officer (Final), South 24 Parganas to dispose of the representation of the writ petitioner, as referred to in the order dated September

24, 1998 passed in W.P.17923 (W) of 1998, in the following manner:

i) The respondent no.3 shall, within a fortnight from date, issue a notice of hearing to the writ petitioner, specifying therein the date, time and venue of such hearing as well as the exact documents which are required to be furnished by the writ petitioner.

Such date of the hearing shall be fixed latest within January 15, 2026.

Upon such hearing being given on the scheduled date and time to the writ petitioner, along with other interested persons, if any, as well as the State authorities, the respondent no.3 shall come to a conclusion by deciding on the representation of the writ petitioner on the basis of such documents as furnished by the writ petitioner. ii) For such purpose, the respondent no.3 shall, if necessary, extend the time for the writ petitioner to produce such documents as required.

The entire exercise, up to a reasoned order being passed on the representation of the writ petitioner upon hearing all interested persons including the petitioner, shall be completed latest by February 28, 2026.

Immediately thereafter, a copy of such reasoned order shall be forwarded to the writ petitioner. 8.

We have not entered into the merits of the contentions raised by the writ petitioner in the representation and it will be open to the respondent no.3 to decide the same in accordance with law on the basis of the materials before the said respondent. 9.

By virtue of this order, O.A. 2654 of 2016 (LRTT), pending before the First Bench, West Bengal Land Reforms and Tenancy Tribunal, also stands disposed of.

10. There will be no order as to costs.

11. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities. (Sabyasachi Bhattacharyya, J.) I agree.
