The petitioners claim that the private respondents are effecting construction over the property, which is the subject matter of a civil suit being TS No.437 of 2022 pending before the Civil Judge (Senior Division), Alipore. Counsel for the private respondents submits that since after writ petition was filed, an order or injunction was passed in Misc Appeal No.97 of 2022 and the same was dealt with by this Court in CO 2401 of 2022.

In that view of the matter, this Court is of the view that the writ petition is infructuous. Hence, the writ petition shall stand disposed of without any orders.

There shall be no order as to costs.

The Chief Electoral Officer is represented because of notice issued by the petitioners, although, he is not even a party to the instant writ petition.

The report of the Inspector-in-Charge, Bishnupur Police Station dated 21st February, 2023 is taken on record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
