The learned advocate appearing for the petitioners submits that the opposite parties have been duly served and the notice for upgradation was also served upon the opposite party.

After some argument the learned advocate appearing for the petitioners prays for a direction upon the learned Additional District Judge, 8th Court at Alipore to dispose of the Miscellaneous Appeal No. 268 of 2024 expeditiously. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned judge of the appellate court.

This Court finds that 7th October, 2024 was fixed for hearing of the Miscellaneous Appeal No. 268 of 2024. C.O. 3644 of 2024 stands disposed of with the hope and trust that the learned Additional District Judge, 8th

Court at Alipore shall make an endeavour to dispose of the miscellaneous appeal as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
