The petitioner prays for consideration of the representation dated 26th August, 2025 seeking refixation of his pay scale. The said representation is alleged to be kept pending before the District Inspector of Schools (SE), Malda.

Though the receipt showing submission of the representation in the office of the District Inspector of Schools is not annexed to the writ petition, but the learned advocate for the petitioner has produced the postal receipt in original to show that the copy of the subject representation was put to post on 27th August, 2025.

As it appears that the issue regarding refixation of pay is pending consideration before the District Inspector of Schools (SE), Malda, accordingly, the instant writ petition is disposed of by directing the District Inspector of Schools (SE), Malda to consider the prayer of the petitioner for re-fixation of his pay in accordance with law and in line with the Memo No.292 dated 22nd March, 2017 and in the light of the order passed by the Hon'ble Division Bench on 7th January, 2025 in FMA 981 of 2022 with IA No. CAN 1 of 2022 (in the matter of Samarendranath Adak v. The State of West Bengal & Ors.).

An opportunity of hearing shall be granted to the petitioner for production of all documents in support of his prayer for re-fixation of pay. 6.

A decision shall be taken in the matter at the earliest, but positively within a period of twelve weeks from the date of communication of this order. 7.

A reasoned order shall be passed and communicated to the petitioner.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken without any further delay.

The writ petition stands disposed of.

10. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
