On 23.02.2012 the petitioners were directed to serve notice together with copy of application upon the opposite parties within one week and file affidavit of service on the next date of hearing. There is no compliance of the order. No accommodation is sought for. An interim order of stay of proceeding in respect of G.R No.2701 of 2011 was passed on 23.02.2012 for ten weeks. No interim order subsists as on date.
The petitioners' prayed for quashing of proceeding in connection with Deganga Police Station case No.322 dated 15.06.2011 under Section 498A/34 of the Indian Penal Code giving rise to GR No.2701 of 2011 and charge sheet no.282 dated 31.7.2011 pending before the learned Judicial Magistrate, Barasat. This matter is pending for ten years and the status of the GR case 2701 of 2011
is not known. Without any stay order regarding proceeding of GR case No.2701 of 2011, this application has become infructuous. The revisional application is therefore, dismissed for default. Connected application, if any, is also disposed of. Let a copy of this order be sent to the learned Chief Judicial Magistrate, Barasat for information.
