The writ petitioner seeks a direction upon the DL-22 12.10.2023 Court No.5 (AD) Tribunal to hear and dispose of an application for substituted service being M.A. 162 of 2022 filed in O.A. No.1183 of 2013 (LRTT).

Private respondent no.56 is represented.

Affidavit of service filed in Court be taken on record. Learned Advocate appearing for the writ petitioner submits that, M.A. 162 of 2022 is an application for substituted service upon the private respondents since, service on all the private respondents could not be effected. In a proceedings before the Tribunal, the principles of the Code of Civil Procedure, 1908 applies.

Therefore, the Tribunal is required to consider and dispose of the application for substituted service on the private respondents.

In such circumstances, it would be appropriate to

direct the Tribunal to consider and dispose of M.A. 162 of 2022 as expeditiously as possible and preferably within six weeks from the next date fixed being January 15, 2024. Learned Tribunal is requested not to grant unnecessary adjournment to any of the parties. WPLRT 162 of 2022 is disposed of without any order as to costs.
