Kausik (Allowed) CRM (M) 1377 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Lalgola Police Station Case No. 899 of 2024 dated 2nd of September, 2024 under section 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioners submits that the petitioners are similarly situated as Tosikur Ahamed @ Nawabab who has been granted bail by the Hon'ble Apex Court in Criminal Appeal No. 4540 of 205.

Learned advocate for the State submits that during the subsequent stages, charge sheet has been submitted and the FSL Report has also been made available to the learned Special Court.

Having considered the period of detention, the recovery being made from the joint possession of the accused persons and the petitioners being similarly situated as other person who has been granted bail by the Hon'ble Apex Court, I am of the view that, the petitioners are entitled to the same benefit.

As such the prayer for bail of the petitioners namely Sohobul Sk. and Rajesh Sk. are allowed.

Petitioners shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand) each. One of whom must be local to the satisfaction of the learned Special Court under the NDPS Act, Berhampore Murshidabad.

If on bail the petitioner shall be physically present before the learned Trial Court on each and every date. Petitioner shall not leave the jurisdiction of District of Murshidabad without prior permission of the learned Special Court.

Accordingly, CRM (NDPS) 1377 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
