Perused the report prepared by the District Inspector of Schools (Secondary Education), Dakshin Dinajpur.

It appears therefrom that though the petitioner retired from service on January 31, 2019 but PPO was issued only on September 9, 2021 and pension released on October 1, 2021.

According to the District Inspector of Schools, terminal dues of the petitioner could not be released immediately on his retirement due to pendency of litigation before this Court.

An appeal being MAT 285 of 2021 with two connected applications being CAN 1 of 2021 and CAN 2 of 2021 was pending consideration before the Court. The writ petition was filed by the petitioner in the year 2020. Order was passed in appeal on March 22, 2021 directing the District Inspector of Schools to send the pension papers of the petitioner to the DPPG and immediately thereafter the authorities took steps in the matter.

Learned senior counsel representing the petitioner submits that interest ought to be given from the date of the order till the date of actual payment. 6.

The Court is not inclined to accept the submission of the petitioner.

Admittedly, the respondents took steps in compliance of the direction passed by the Court. Preparation of the pension file requires some time and the authority released the payment on October 1, 2021. It does not appear there has been any intentional delay or laches on the part of the authority in releasing the pension of the petitioner. 7.

In view of the above, the prayer of the petitioner seeking interest on account of delayed payment of terminal dues cannot be accepted.

The writ petition accordingly fails and is hereby dismissed.
