Learned advocate appearing for the petitioner submits that the petitioner was out of India when the incident complained of in the letter of complaint addressed to the concerned officer was registered as FIR relating to New Barrackpore P. S. Case No. 142 of 2023 dated 28-05-2023. To that effect, learned advocate for the petitioner intends to produce the documents. The same is plea of alibi. The genuinity of the same is to be considered by the Investigating Agency who is in seisin of the matter. Having considered that the investigation of the case is still under progress, I am not inclined to interfere with the investigation of the case. However, if the petitioner produces such documents reflecting that he was out of India, the Investigating Agency would consider the complicity of the petitioner in the background of the allegations made in the FIR.

With the aforesaid observations, the present revisional application being CRR 4022 of 2023 is disposed of.
