Mr. Subrata Ghosh .... For the Petitioner Ms. Baisali Basu ....For the State In view of the apprehension expressed by the petitioner, I direct the learned ACJM, Bolpur to inform the Officer-in-Charge of the Bolpur Police Station to provide adequate security to the petitioner on the specified dates fixed by the Court. The petitioner is apprehensive regarding an alleged previous incident, which has taken place within the Court premises but outside the Court room. Records reflect that at the relevant time some escort was provided to the petitioner and in spite of that it has been submitted that an untoward incident has taken place although genuineness of the same was denied by the concerned Officer-in-Charge of the Bolpur Police Station.
Be that as it may, I further direct that the petitioner apart from being provided with constable, may be provided with lady constable as the petitioner apprehends that his wife may physically assault him.
would take such party in custody and refer the matter to the learned District Judge, Suri, Birbhum for imposing condition for proper behaviour in Court. Report so submitted by Ms. Baisali Basu, learned advocate for the State be kept with the records.
With the aforesaid directions, CRR 3462 of 2018 is disposed of.
Learned Magistrate is further directed to take the proceeding relating to Misc. Case No. 18 of 2014 under Section 125 of the Code of Criminal Procedure to its logical conclusion within a period of three months from date. Pending application, if any is consequently disposed of. Interim order, if any is hereby vacated.
