Mr. D. Mukherjee Mr. Tarak Nath Sarkar ... for the State The Petitioner, being a primary teacher working under District Primary School Council, Jhargram prays for transfer. In support of such prayer, the attention of this Court has been drawn to the transfer application dated 20.08.2024 which is at page 19 of the writ petition wherefrom it appears that the petitioner, being a surplus teacher made such application for transfer. It is submitted that since the petitioner has completed five years of confirmed service as primary teacher, there is no impediment under the relevant transfer rules in transferring the petitioner from his present school to another school in the district of Paschim Medinipur. Bengal Board of Primary Education submits that the Secretary of the Board may be directed to consider the transfer application of the petitioner in accordance with law.

Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing the Secretary, West Bengal Board of Primary Education being respondent no.4 to decide the transfer application of the petitioner by eight weeks from date of communication of this order. Decision to be taken by respondent no.4 shall be communicated to the petitioner by fortnight thereafter.

However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree Portal.

There shall be, however, no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
