It is claimed in the application that no previous application for anticipatory bail was filed, although, an earlier application for anticipatory bail of the petitioners being CRM 2803 of 2022 was rejected on June 17, 2022.

In view of such false statement, made on oath, the police will file a complaint against the person affirming the affidavit being Rajat Mondal as well as against the petitioners renewing the prayer for anticipatory bail, inter alia, under Section 340 of the Code of Criminal Procedure.

In view of the petitioners coming with unclean hands and suppressing material facts, it would be appropriate to put the petitioners on terms.

Each of the petitioners will pay costs assessed at Rs.20,000/- (Rupees twenty thousand) to the State Legal Services Authoriteis, Kolkata, within seven days from date. In the event of the petitioners failing to produce documentary evidence of the costs as awarded being paid, within ten days from date, the Officer-in-Charge of the Police Station where the police complaint was lodged, is directed to initiate proceedings for recovery of the costs so awarded as arrears of land revenue against the petitioners.

Prayer for anticipatory bail is rejected.
