Mr. Ganguly, learned senior advocate appearing for the petitioner is aggrieved by the factum of defreezing of the accounts of the petitioner company viz. M/s Nijji Healthcare Private Limited. Learned Chief Judicial Magistrate, Howrah in connection with Chatterjeehat Police Station Case No. 71 of 2023 by its order dated 26.09.2023 was pleased to keep the application pending.

Having considered the subject-matter of the case and the attention of the Court being drawn to the letter of complaint wherein there are allegations relating to withdrawal of cash amounting to Rs.67,90,000/-, I direct that the learned Chief Judicial Magistrate, Howrah will take into account the subject-matter of total quantum which has been alleged either has directing the petitioner to ensure the amount separately or in the alternative attach the said amount of money which is lying in the accounts of the petitioner/company and allow the petitioner to operate the accounts.

Learned senior advocate has drawn the attention of the Court to both the accounts being maintained with ICICI Bank

(A/C. No. 090105500041) and HDFC Bank (A/C. No. 50200019000704).

The learned Chief Judicial Magistrate, Howrah would on the attention of the said court being drawn, try to dispose of the said petition dated 12.09.2023 which was deferred on 26.09.2023 within seven days preferably by 31.10.2023. The petitioner is directed to communicate this order to the learned Chief Judicial Magistrate, Howrah as well as the investigating officer of the case.

The learned court and the investigating officer of the case will inform the affected parties before the date fixed for hearing.

With the aforesaid observations, the revisional application being CRR 4024 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
