The petitioners complain that the private respondents are effecting construction over Panchayat land, which is obstructing free ingress and egress of the petitioners to their property.

Counsel for the private respondents submit that they have obtained Patta in respect of the said land and have effected construction thereof.

This Court is of the view that the dispute as regards the construction by the private respondents can be raised before the Panchayat. It is for the latter to decide as to whether any construction has been raised on the Panchayat Land.

The Nakashipara Police has no role to play in the matter. Nakashipara Police shall, however, ensure that there is no breach of peace in the area.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.
