In CRR 4142 of 2022, the order of a different revisional application was transcribed. The said order dated 05.07.2023 is accordingly recalled.

The following order which was transcribed in the other revisional application being CRR 4114 of 2022 would be considered to be the order in this case and the same is as follows:- Petitioner is directed to serve a copy of the revisional application upon Mrs. Manasi Roy, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Mr. Chatterjee, learned advocate appearing on behalf of the petitioner is anxious regarding the warrant of arrest, which according to him was issued without his knowledge. Learned advocate undertakes that the petitioner would abide in future by the orders passed by the learned trial court and adhere to the schedule fixed by the said court.

In view of the aforesaid, I direct that in case the petitioner

surrenders by 25th July, 2023 before the learned trial court and find from the records of the case that the petitioner was on bail, then he would allow the petitioner to continue on the same bail and bond with additional conditions before the court to ensure his appearance in future.

In case, the petitioner do not appear within the schedule date so fixed, the learned trial court on 26th July, 2023 would proceed to the next harsher process of law for compelling the appearance of the present petitioner.

The execution of warrant of arrest so far as the present petitioner is concerned is stayed till 25th July, 2023. With the aforesaid observations, the present revisional application being CRR 4142 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. This order may be treated as part and parcel of the original dated 5.07.2023.

Department is directed to incorporate the necessary corrections.

Learned Magistrate is directed to act on the server copy duly downloaded from the official website of this Court. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
