Mr. Debasish Ghosh, Ms. Piyali Sengupta ...for the State The petitioner is aggrieved that a permission already granted by the Sub-Divisional Police Officer, Khatra, Bankura on November 11, 2022, for holding of a rally to commemorate the birth anniversary of famous tribal freedom fighter, 'Birsa Munda', was subsequently withdrawn.

Debasish Ghosh, learned counsel appearing for the State would submit that, the application of the petitioner did not specify that the leader of opposition with 'Z' category security was going to be part of the rally. It is also mentioned that the application did not exactly specify that it was being held to commemorate the birth anniversary of the said tribal leader.

Counsel for the petitioner sincerely regrets the omissions on the part of his client. There is substance in the apprehensions of the State that when a 'Z' category security covered person is visiting an area that borders on a Left Wing Extremists area, appropriate security is required to be arranged. The police, given the number of the celebrations of the birth anniversary of the personality concerned, across the State, may be unable to deploy such force, without prior notice. In those circumstances, the CRPF is directed to provide appropriate security in the area to ensure that there is no additional pressure on the State police machinery for the purpose of holding the aforesaid rally.

The petitioner and his organization, shall hold their rally peacefully and on the terms and conditions already granted in the communication dated November 10, 2022, issued by the SDPO, Khatra, Bankura.

The petitioner as well as the CRPF shall communicate the arrangements made for the rally to the I/C, Raipur Police Station, Bankura forthwith.

All the concerned parties shall cooperate with each other for the aforesaid purpose.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
