Petitioner by presenting this writ petition has prayed for continuity in service as Group -D staff based on a document which is at page 40 of the writ petition. It is submitted that as per said document at page 40 of the writ petition petitioner was appointed as Group -D staff in Forest Development Corporation of India.

It is contended that petitioner was paid salary lastly in the month of November, 2018 and thereafter he was terminated from service. From the month of December, 2018 petitioner has not been getting salary.

Considering the document at page 40 of the writ petition and case made out in the writ petition, it does not appear that petitioner was appointed on substantive basis as Group -D staff. Moreover, on perusal of document at page 40 it

appears that said document does not bear any date. Unless and until a candidate is appointed on substantive basis he/she does not have enforceable right to claim continuity in service. 4.

As per submission made on behalf of the petitioner it transpires that petitioner was paid salary lastly in the month of November, 2018. In the meantime seven years have passed. No termination order is available on record in order to examine the validity of such termination.

It also appears from record that Forest Development Corporation of India has not been arrayed as party.

In view of aforesaid scenario, this Court has doubt whether petitioner was at all appointed or not on substantive basis.

Hence, writ petition stands dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
