Petitioners are in custody for over two years. They pray for bail on the ground of delay.

Learned Advocate for the State submits trial has substantially progressed. Most of the witnesses have already been examined.

We have considered the materials on record. 518 bottles of phensedyl syrup containing codeine phosphate was recovered from the petitioner.

Trial has considerably progressed. 12 out of 13 witnesses have been examined. 4.

Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners.

Accordingly, the prayer for bail of the petitioners is rejected.

Trial Court is directed to conclude the trial at an early date without granting unnecessary adjournment to either of the parties.
