As the writ petition has been filed by the petitioner with a prayer that a polygraph test should be conducted to prove his innocence and the same do not adversely affect the respondent no. 4, service upon the respondent no. 4 is dispensed with.

Mr. Banerjee learned senior standing counsel appears on behalf of the state.

Case diary has been produced before this court. I have perused the case diary. The investigation of the case is in progress. At the stage of investigation it is for the investigating agency and the investigating officer to decide the mode and manner of investigation to come to a conclusion in respect of the allegations and the materials collected in course of the investigation. The efforts which would be taken by the

investigating officer, for the purpose of arriving at its conclusion to unearth the truth is an exclusive domain of the investigating agency. Court at this stage cannot direct the investigating officer to do or not to do any particular act. The petitioner has definitely come up with an innocuous prayer but the same is prematured.

Accordingly WPA 25298 of 2024 is dismissed with liberty to the petitioner to approach this court at the appropriate stage.
