Learned counsel appearing on behalf of the petitioner submits that the only material available against the petitioner is the statement of the co-accused.

Learned counsel appearing on behalf of the State submits that proclamation had been issued against the present petitioner. The trial had to be split up. Date has been fixed for evidence in respect of the other co-accused. So far as the present petitioner is concerned, other than the statement of the accused, the prosecution case is that he was there at the place of occurrence, but fled away. Considering the above and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
