And In the matter of: Hadikul Sk @ Hadikul Seikh ....Applicant/Petitioner Ms. Sabrina Parveen ...for the petitioner Mr. Suman De Ms. Debarshi Brahma ..for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, there is no other incriminating material available against the present petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the report and the case diary and submits that at the relevant time, there were phone calls between the petitioner and the principal accused. The petitioner also has a criminal antecedent involving the NDPS Act. Actually, the petitioner was a supplier of the contraband.

Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
