Union of India Mr. Gour Baran Sau, Mr. Arshad Hussain .. for the applicants Mr. Amarendra Chakraborty .. for the Union of India Mr. Dipankar Das ..for the Respondent No.1-NHAI Mr. Gour Baran Sau, learned Advocate appearing on behalf of the applicants submits that the petitioner No. 1, Narasingha Prasad Gupta expired on 2nd October, 2021, and during his lifetime executed a registered Will dated 2nd January, 2015, and appointed the applicant Sri Anil Kumar Saha, as the executor. The applicant has filed an application being Miscellaneous Case No. 21 of 2021 for grant of probate before the learned Civil Judge (Senior Division), 1st Court, Malda and the said proceeding is still pending. He seeks of accommodation to move the present applications after the grant of probate.

Let the matter go out of list with liberty to mention.
