09/12/2025 D/L - 18 Court No.28 S. Kundu Rejected C.R.M.(A) 3651 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Tehatta P.S Case no. 766 of 2025 dated 29/9/2025 under Sections 85/117(2)/109/3(5) of the BNS.

In the matter of: Saddam Mondal

...Petitioner.

Mr. Asraf Mondal Mr. Tanbir Mondal ...for the petitioner.

Mr. Debabrata Chatterjee Mr. Atanu Ghosh ...for the State.

1. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case. He is the husband of the victim. The victim had left the matrimonial home on her own accord.

2. Learned counsel appearing for the State files a report, which is taken on record. He relies on the report, the case diary and submits as follows. The petitioner committed physical and mental torture upon the victim. There is an injury report present at page 22 of the case diary that shows injuries inflicted on the victim. Reliance is also placed on the statements of the victim as well as her minor daughter. According to the subsequent statement of the victim recorded on 30/11/2025, the victim was constrained to stay at her paternal home due to torture meted out by the petitioner and the in-laws.

3. Considering the above and the other materials available in the case diary including the statement of the victim, the child and the injury report, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
