....Applicants/Petitioners Mr. Asraf Mandal ...for the petitioners Mr. Pravas Bhattacharya Mr. Arup Sarkar ..for the State Learned counsel appearing on behalf of the petitioners submits that there are case and counter case. The petitioners also suffered injuries.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses including the victim and the injury report. There is a cut injury on a vital part of the body like scalp that required five stitches to repair and injury was caused on the head with a brickbat. Considering the above, the other materials available in the case diary and the alleged roles ascribed to each of the present petitioners, while I am inclined to grant anticipatory bail to the petitioner nos. 2 and 3, the application for anticipatory bail of the petitioner no.1 (Firoz Sk.) is rejected.

Accordingly, the application for anticipatory bail of the petitioner nos. 2 and 3 is allowed.

In the event of arrest, the petitioner nos. 2 and 3 (Biru @ Mijbahur Rahaman Sk. and Niyamat Sk.) shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner nos. 2 and 3 shall not threaten or intimidate witnesses and shall co-operate with the investigation. The petitioner nos. 2 and 3 shall meet the I.O. once a week till submission of report in final form.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
