Mr. K. Kubra ... for the petitioner Ms. Amita Gaur Md. Y.A. Ismail ... for the State Learned senior counsel representing the petitioner submits that the petitioner is a differently abled person. He is only a Nirman Sahayak in the concerned Gram Panchayat. He has nothing to do with the issuance of any fake sanctioned plan.

Learned counsel for the State strongly opposes the prayer for anticipatory bail and relies on the statements of witnesses including the victims and colleagues of the petitioner as well as an admission made by the petitioner before the ADM, Malda Zilla Parishad and other incriminating materials available in the case diary. Considering the above, the other materials available in the case diary and the alleged role ascribed to the present

petitioner, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
