Rakib (Rejected) CRM (NDPS) 1380 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachawk Police Station Case No. 667 of 2024 dated 15.05.2024 under Sections 21(c)/27A/29 of the NDPS Act.

Learned advocate appearing for the petitioner is aggrieved regarding the unnecessary detention of the petitioner for more than one year five months. Learned advocate submits that there has been no recovery from the petitioner, yet the petitioner has been unnecessarily detained. It is stated only three witnesses have been examined out of proposed ten witnesses which the prosecution has relied upon in the chargesheet. Learned advocate appearing for the State on the other hand opposes the prayer for bail and submits that earlier on two occasion the prayer for bail of the petitioner has been
rejected. The examination of the witnesses is in progress and the next date is fixed in the month of November, 2025. In view of the recoveries and the materials which the prosecution alleges against the present petitioner, at this stage I am not inclined to release the petitioner on bail. As such, CRM (NDPS) 1380 of 2025 is dismissed. However, the learned trial Court would ensure that the prosecution evidence is completed by 30th of September, 2026. The trial of the case would continue in spite of any resolution of the local bar and the accused persons are directed to cooperate with the progress of the trial of the case.
Learned trial Court would act on the server copy of this order, if handed over by the learned counsel appearing on behalf of the petitioner as also the State.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
