Ct.No.28 as/tkm (Rejected) C.R.M. (DB) 4004 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Patashpur P.S. Case No.234 of 2020 dated 11.06.2020 under Sections 498A/307/34 of the Indian Penal Code.

In the matter of : Sanjoy Ari & Anr.

... Petitioners.

Mrs. Rupsa Sreemani.

...for the Petitioners.

Mr. Saswata Gopal Mukherji, ld. P.P., Mr. Aniket Mitra.

...for the State.

Petitioners renew their prayer for bail. They are in custody for 888 days.

Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record. Dying declaration of the deceased implicates the petitioners in the crime. They do not stand on the same footing with the coaccused-husband who is on bail. Under such circumstances, we are not inclined to grant bail to the petitioners.

Accordingly, the prayer for bail of the petitioners is rejected.

Trial court is requested to expedite the trial and conclude the same at an early date without granting unnecessary adjournments to either of the parties.
