Affidavit of service filed by the petitioners and report submitted by the State are taken on record.

The private respondents are not represented despite service.

Heard learned counsels for the parties.

The petitioners allege that they are not allowed to cut the ripe paddy from the field owned by them.

In an earlier writ petition filed by the private respondents a co ordinate Bench of this Court by an order passed on 19th January, 2023 in WPA 214 of 2021 directed the SDPO, Lalbagh to ensure that there was absolutely no breach of peace in the area.

Learned counsel for the petitioners submits that despite such direction, the private respondents are creating disturbance in the peaceful possession of the petitioners in the property.

Learned counsel for the State submits that an order of status quo was granted upon both the parties in the said

suit and both the parties have violated the said order by continuing to cultivate the land.

It appears that the dispute between the parties is civil in nature and a civil suit is pending before the learned civil Court. The petitioners have their remedy in the said suit.

In the meantime, the police authority shall continue surveillance in the area in view of the strained relationship between the parties so that no untoward incident occurs and law and order is maintained.

The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
