It is a proceeding under the provisions of the PWDV Act and is pending before the Learned Metropolitan Magistrate, 11th Court, Kolkata.

Learned advocate for the petitioner submits that there are no arrears in connection with the present case as the petitioner intends to contest the case both on the issues relating to the domestic violence as well as interim relief so granted. Learned advocate submits that the evidence of the applicant/ aggrieved person is to be considered first but thirteen dates have passed and for one reason or the other the applicant is taking time. He submits that the applicant/aggrieved person is purposefully evading the process of.

In view of the grievance expressed by the petitioner before this Court, I am of the opinion that the same is justified. Learned Magistrate would insist upon the applicant/aggrieved person so that her evidence should be completed within a reasonable period of time.

Learned Magistrate would also take steps so that unnecessarily MSCN 33 of 2020 is not dragged. All efforts be taken to conclude the case at the earliest. With the aforesaid observations, CRR 4040 of 2023 is disposed of.
