Learned advocate appearing for the petitioner submits Bpg.

Dismissed that the petitioner was not named in the FIR and subsequently his name has been incorporated. It is submitted that the accusation so far as the present petitioner is concerned is restricted only to threatening the victim and so far as the conduct of the petitioner is concerned, petitioner appeared and surrendered before the learned court when he was taken into custody and he is in custody for 80 days.

Learned advocate for the State submits that proclamation was issued against the present petitioner and others. Attention of the Court was drawn to the statement under Section 164 of Cr.P.C. as well as other relevant statements of the witnesses. Be that as it may, the case is of the year 2023. Petitioner appeared and surrendered before the learned trial court and is in

custody for 80 days. Other accused persons are still absconding, according to the learned advocate appearing for the State. State is directed to exhaust whole of the process against the absconding accused persons and thereafter pray for splitting up of the trial. At this stage, the prayer for bail of the petitioner is rejected.

Petitioner would be at liberty to renew the prayer for bail after the case is committed to the court of sessions. Accordingly, CRM(M) 2200 of 2025 is dismissed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
