Dekhan Khatoon & ANR v. State Of West Bengal
18.09.2025 Item No.20 Ct. No. 446 PG CRR 3326 of 2012 Dekhan Khatoon & Anr.
Vs.
Husnara Begum & Anr.
Ms. Sunandana Saha ......For the Petitioners
1. None appears on behalf of the petitioners. On careful perusal of the record, it transpires that by virtue of a direction passed by the coordinate Bench of this Court, the administrative notice was directed to be served upon the opposite party no. 1 through the learned Registrar (L & OM) and subsequently, further direction was given to produce the opposite party no. 1 before the Court on the next hearing date. However, subsequent thereto, no order can be seen regarding production of the opposite party no. 1. However, the record reveals that such order was duly communicated to the opposite party no. 1 and the notice was duly served upon her.
2. Despite that, nobody is appearing to represent the petitioner. This revisional application is pending since 2012 against an order dated 19.06.2012 passed by the learned Chief Judicial Magistrate, Uttar Dinajpur at Raigunj in C.R. 509 of 2011, whereby the interim order of maintenance was granted. Since nobody is representing the petitioner or the opposite party no. 2 herein despite having knowledge, this Court finds no reason to keep the matter pending.
3. Accordingly, this revisional application is dismissed for default.
4. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Chaitali Chatterjee (Das), J.)
