1. The parties are not represented even in the second call nor any accommodation is prayed for on their behalf.

2. The appeal is pending since 2001. The appeal was appearing in the warning list of cases on and from 19th July, 2023 with a clear indication that the said matter shall be transferred to the main list on and from 1st August, 2023. The said appeal along with the application continued to appear in the list on and from 19th July, 2023. All the parties have sufficient notice about the listing of the matter before the main list on and from 1st August, 2023. In spite of notice, the parties are not represented. It thus shows that the parties are not interested to proceed with the appeal and the application.

3. Under such circumstances, the appeal and the connected application are dismissed for default.
