Respondent No. 1 is not represented.
The petitioner effectively prays for an early disposal of its application No. 1 of 2017 pending before the Central Government Industrial Tribunal cum Labour Court, Asansol. The application was last taken up for consideration in the month of November 2024 and the next date is fixed on August 20, 2025. In view of the urgency pleaded in the writ petition, the petitioner shall be at liberty to apply before the jurisdictional Tribunal cum Labour Court for preponement of hearing.
In the event such an application is filed, the same shall be considered by the jurisdictional Tribunal cum Labour Court in accordance with law.
It is made clear that, this Court has not gone into the merits of this writ petition. The parties shall be at liberty to urge whatever points they wish to urge before the jurisdictional Tribunal cum Labour Court in the pending application. The jurisdictional Tribunal cum Labour Court shall come to a reasonable conclusion with reasoned order as expeditiously as possible but preferably within a period of two months from the date of commencement of hearing without granting any unnecessary adjournment to the parties.
Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.
With the above terms, this writ petition, WPA 24306 of 2023 stands disposed of, without any order as to costs.
