Mr. Dilip Kumar Maity ...for the Petitioner Mr. Sudip Sarkar, Mr. Janardan Mondal ...for the State The petitioner submits that he is posted as a Clerkcum-Typist at the Sagar Panchayat Samity (respondent no. 7), located at Village and Post Office - Rudranagar, Police Station - Sagar, District - South 24 Parganas. The petitioner further submits that he made an application for inter-district transfer before the Commissioner, Panchayat and Rural Development, Government of West Bengal. However, the said application has not yet been considered.

The learned advocate appearing on behalf of the State has, however, drawn the attention of this Court to the first proviso to Rule 7 of the West Bengal Panchayat (Panchayat Samity Administration) Rules, 2008, and has submitted that the petitioner ought to have made the application before the Executive Officer of the concerned Panchayat Samity in the first instance, seeking such inter-district transfer.

Upon due consideration, I find substance in the

submission advanced on behalf of the State.

In view of the aforesaid, this writ petition is disposed of with liberty to the petitioner to make an application before the Executive Officer of the concerned Panchayat Samity seeking inter-district transfer, within a period of two weeks from the date of this order.

If such an application is made, the same shall be processed in accordance with Rule 7 of the West Bengal Panchayat (Panchayat Samity Administration) Rules, 2008 and in accordance with law, as expeditiously as possible. Accordingly, WPA 24770 of 2025 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
