Learned advocate representing the concerned District Inspector of Schools (SE) submits that vide memo dated 23rd December, 2024 authority of the school where petitioner's mother was a non-teaching staff was requested to submit documents as indicated in the said memo dated 23rd December, 2024.

It appears that the documents are required to be submitted by the petitioner otherwise school authority in its own will not be able to submit those documents for finalization of family pension case of the petitioner.

Petitioner is granted leave to submit requisite documents in terms of memo dated 23rd December, 2024 by four weeks from date

before the District Inspector of Schools (SE), South 24 Parganas being respondent no.3 with assistance of the authority of Desh Bandhu Pally Seva Sangha Santosh Kumari Siksha Niketan (HS), South 24 Parganas. In the event documents in terms of memo dated 23rd December, 2024 are submitted before the respondent no.3, steps shall be taken by forwarding family pension case of the petitioner to the Director of Pension, Provident Fund and Group Insurance being respondent no.2 by two weeks thereafter. On receipt of papers by the respondent no. 2 from respondent no. 3, respondent no. 2 shall issue Pension Payment Order in favour of the petitioner for releasing family pension within four weeks thereafter.

With the above observations and direction, writ petition stands disposed of.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
