The petitioners seek consideration of the representation filed before the Deputy Collector (S.S.Unit), Kolkata Municipal Corporation on 25th August, 2022.

Certain queries have been made by the petitioners in the said representation. The same are yet to be answered.

Without going into the merits of the prayer of the petitioner at this stage, as it appears that, the representation of the petitioner is pending

consideration at the end of the respondent authority, accordingly, the instant writ petition is disposed of by directing the respondent No. 4 being the Deputy Collector (S.S.Unit), Kolkata Municipal Corporation to consider the representation of the petitioner dated 24th August, 2022, received by the office of the respondent authority on 25th August, 2022, in accordance with law, after giving a reasonable opportunity of hearing to the petitioners and other necessary parties at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order. The aforesaid respondent shall pass a reasoned order and communicate the same to the parties immediately thereafter.

It is made clear that this Court has not entered into the merits of the claim made by the petitioners and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation of the petitioners.

The petitioners are directed to forward a copy of the representation dated 24th August, 2022 to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
