As the said case is under Section 340 of the Code of Criminal Procedure, learned Magistrate would give an appropriate direction for enquiry and would be at liberty to either proceed or drop the said proceeding.

Whole of the issue in respect of the prima facie finding as directed above be completed within a period of six months from the next date so fixed.

With the aforesaid observations, CRR 4041 of 2023 is disposed of.
