1. The vacancy list of the preferred schools nearby the residence of the petitioner as forwarded by the District Inspector of Schools, Secondary Education, North 24 Parganas is taken on record.

2. It appears that four schools have been found to have vacancies. Out of the four, one i.e. Madhyamgram APC Vidyayatan has an issue with the roaster.

3. There are other three schools where the petitioner may be transferred. The petitioner prefers to join Madhyamgram High School.

4. As it appears that the recruitment process of filling up the vacancies of assistant teachers is currently ongoing, accordingly, the

Commission is not aware as to whether the vacancy in the other three schools have been reported for being filled up through the recruitment process.

5. In view of the above, the instant writ petition stands disposed of by directing the West Bengal Central School Service Commission to conduct a hearing to ascertain as to whether the vacancy still exists in the following schools where the petitioner may be appointed on transfer:- i) Gustia Kshetranath High School ii) Barasat Kalikrishna Girls High School iii) Madhyamgram High School

6. If any of the aforesaid schools as available, then option may be provided to the petitioner for joining the same.

7. If the vacancy is not available in the aforesaid schools preferred by the petitioner, then the petitioner may be provided option to join any other school which is close to her residence.

8. Steps shall be taken by the Commission at the earliest but positively within a period of eight weeks from the date of communication of this order.

9. A copy of the instruction forwarded by the District Inspector of Schools, Secondary Education, North 24 Parganas has been handed over to the learned advocate representing the Commission for onward transmission to the authority.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
