State Election Commission 01-08-2024 AKG Ct. 15 In the earlier round of writ petition WPA 15344 of 2023, (Sk. Alim Vs. West Bengal State Commission & Ors.), the petitioner alleged that the nomination papers of the respondents filed in connection with the Panchayat Election 2023 do not disclose the proper annual income and the names of bank/institution from where loan has been obtained by the respondents. It was also alleged that the names of fake witnesses have been mentioned in the nomination papers. The said writ petition was disposed of by a Co-ordinate Bench of this Court by an order dated June 30, 2023 directing the election commission to rescrutinize the details of the candidates mentioned in the writ petition and if it appeared that there were any error in the details, non disclosure of relevant information or defects in the nomination papers, to take necessary consequential steps in the matter.
In compliance with the said order, the West Bengal Election Commission passed an order dated July 2, 2023, holding that the respondents were not disqualified from contesting the Panchayat Election, 2023.
The petitioner has challenged the said order dated July 2, 2023, passed in this writ petition.
Learned advocate appearing for the petitioner submits that the petitioner has challenged the reasons contained in the order dated July 2, 2023.
The Panchayat General Election, 2023 is over. The challenge to the order dated July 2, 2023 has, therefore, become infractuous. Therefore, I am not inclined to entertain this writ petition.
Accordingly, WPA 24322 of 2023 is dismissed.
