This is an application under Article 226 of the Constitution of India praying for direction upon the respondent authorities to publish the result of the interview dated 19.05.2022 held in terms of the Government Notification dated 26.01.2022 issued by the Sub-Division Controller (Food & Supplies) Raiganj, Uttar Dinajpur.

A report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. A notification was issued vide memo no.03/ESTT/SCFS/RGJ/2022 for filling up the vacancy of FPS dealership at Village-Khatasa (near Anganwadi Centre), Mouza-Khatsa, J.L. No.155, Gram Panchayat Malgao, P.O.- Kaliyaganj, PS-Kaliyaganj, District-Uttar Dinajpur. The petitioner received a communication that the said petitioner and six other candidates were called for an interview on 19.05.2022 at 3.00 p.m.. The interview was held, but the result was not published.

The petitioner is apprehensive that the respondent authorities are indulging in illegal activities.

Learned counsel for the State submits as follows. The process of selection has not been finalised yet. At this stage the petitioner, being a participant in the process, has no right to approach this Court for any relief. Once the selection process is complete, necessary steps would be taken for publication of the result. The application is, thus, a premature one. I have heard the learned counsels appearing for the parties and have perused the writ petition and the report filed. It appears that the petitioner had participated, along with others, in the selection process for an FPS dealership and the selection process is not yet complete. Therefore, I do not find any reason to interfere with the process. Accordingly, the writ petition is dismissed.

However, there shall be no order as to costs. The respondent authorities in the meantime shall complete the selection process in accordance with law. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
